1. Agreement to terms

By accessing or using the Viralinn website (viralinn.com) and the Viralinn platform ("Services"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Services.

2. Description of services

Viralinn provides an AI-powered creative platform that enables businesses to generate user-generated-style content (UGC), including video, images, voiceovers, and scripts, for advertising and marketing purposes. We also offer strategy consultations and related services.

3. Account registration

To access certain features you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information and to update it as necessary.

4. Subscriptions and payments

Paid features are billed on a recurring subscription basis or via one-time token purchases, as described on our pricing page. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Refunds are handled in accordance with our refund policy or as required by applicable law.

5. Token usage

Tokens are consumed when you use generation features (video, image, voiceover, upscale, AI scripts). Subscription tokens that are unused at the end of a billing cycle may roll over for up to two billing periods, after which they expire. Purchased tokens do not expire. Token costs per generation are displayed before you confirm each action.

6. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation
• Generate content that is defamatory, obscene, hateful, or that infringes on the rights of others
• Attempt to reverse-engineer, decompile, or extract source code from the platform
• Interfere with or disrupt the integrity or performance of the Services
• Resell, sublicense, or redistribute access to the platform without our written consent

7. Intellectual property

Content you generate using the Services is yours to use for your business purposes, subject to any applicable third-party model license terms. The Viralinn platform, branding, software, and documentation remain the exclusive property of Viralinn.

8. Communications and SMS

By providing your contact details, you agree that Viralinn may contact you by email regarding your account, inquiries, booked calls, and service-related updates. SMS/text messaging consent is collected separately via explicit opt-in. You can opt out of SMS at any time by replying STOP. See our Privacy Policy for full details.

9. Third-party services

The Services integrate with third-party providers (e.g., Stripe for payments, AI model providers for generation). Your use of these integrations may be subject to their respective terms and policies. Viralinn is not responsible for the practices of third-party services.

10. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI-generated content will be error-free, suitable for any specific use, or free from bias.

11. Limitation of liability

To the maximum extent permitted by applicable law, Viralinn and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total aggregate liability shall not exceed the amounts you paid to Viralinn in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Viralinn from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Services at any time for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users or the business. You may cancel your account at any time through account settings or by contacting support.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Changes to these terms

We reserve the right to modify these Terms at any time. The updated version will be indicated by the "Effective date" at the top of this page. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
